I needed to edit and correct this article because I’ve learned some new details. Initially, I believed what many Muslims asserted: Muhammad sexually consummated his marriage to the nine year old Aisha following her first menstruation. HOWEVER, after reading brother Sam Shamoun’s articles (1, 2), I realized that the Quran, the Hadith, and Muslim scholar’s writings state that a Muslim husband can engage in sex with a child-bride before she has her first menses. Further, Muhammad actually did just this – he had intercourse with Aisha prior to her first menses!

This increases the weight and scope of my argument and places Muhammad and Islam in a far darker, more disreputable, light. Many Muslims don’t know this and by their own standards Muhammad did the wrong thing in having sex with a child. Muslims have to answer for their continued support for Muhammad because he transgresses their standards. When children are allowed to be used for sex then that is sexual exploitation; so why do they support the creator and establishment of a system that entrenches the abuse and sexual exploitation of children?

I am not trying to use cheap polemics. Surely you realize that for children there are painful ramifications behind Muhammad’s action. They need to be discussed in detail and in context. It might be offensive to some but it needs to be discussed.

1) INTRODUCTION

Picture this historical setting: A 49 year old man asks his best friend if he could have his permission to marry his 6 year old daughter. His friend agrees. The man then visits his best friend’s house and speaks with the 6 year old daughter. Her parents watch as the he proposes marriage to the child. He is serious; he wants to marry the little girl and is asking for her consent. The little child says nothing; she only stares at him in silence.

The Islamic source materials state that Muhammad proposed marriage to Aisha when she was 6. He assumed her silence constituted her consent. Some 2 to 3 years later, just after he had fled to Medina, he consummated his marriage with her. He was 52 and she was 9. This occurred prior to Aisha’s first menses and by Islam’s legal definition Aisha was still considered a child. Islam teaches that a child enters adulthood at the beginning of puberty. (This is scientifically inaccurate, the onset of puberty does not equal adulthood – see Appendix 3).

The bottom line is Muhammad, the creator of Islam, revered by his followers, had sex with a child! Worse, Muhammad's action and teachings on marriage established an Islamic precedent and Islamic law allows female children to be married off and engaged in sex provided they are able to handle a man’s penis (Quran 65:4). As will be shown, this leads to physical, and psychological, damage to the child.

2) EVIDENCE THAT ISLAM ALLOWS CHILDREN TO ENGAGE IN SEX BEFORE MENSTRUATION

First, we need to establish that Islam allows female children to be married and engaged in sex prior to their first menses (prepubescent). For that we turn to the Islamic source materials. Starting with the Quran:

If you are in doubt concerning those of your wives who have ceased menstruating, know that their waiting period shall be three months. The same shall apply to those who have not menstruated. As for pregnant women, their term shall end with their confinement. God will ease the hardship of the man who fears him. 65:4, Dawood

Brother Sam Shamoun comments on this verse:

The surrounding context deals with the issue of the waiting period for divorce, and remarriage. The Quran is telling Muslims to wait for a certain period of time before making the divorce final or deciding to forego it. The Quran exhorts men to wait a period of three months in the case of women who either are no longer menstruating or haven’t even started their menstrual cycles! (Source)

Since Muslim men are to wait 3 months before divorcing a prepubescent child it means that they have been engaging in sex with those children.



Borrowing from Sam’s work (*) I quote three Islamic scholars commentary related to 65:4 and the subject of sex with prepubescent children:

Al-Tabari said regarding 65:4

The interpretation of the verse "And those of your women as have passed the age of monthly courses, for them the 'Iddah (prescribed period), if you have doubt (about their periods), is three months; and for those who have no courses [(i.e. they are still immature) their 'Iddah (prescribed period) is three months likewise". He said: The same applies to the 'idaah for girls who do not menstruate because they are too young, if their husbands divorce them after consummating the marriage with them.

Regarding sex with prepubescent children, Abu-Ala’ Maududi states:

"Therefore, making mention of the waiting-period for girls who have not yet menstruated, clearly proves that it is not only permissible to give away the girl at this age but it is permissible for the husband to consummate marriage with her. Now, obviously no Muslim has the right to forbid a thing which the Qur’an has held as permissible." (Maududi, volume 5, p. 620, note 13, emphasis added)

It is clear: Muslim men can engage in sex with prepubescent children!

3) EVIDENCE THAT AISHA WAS 9 WHEN SHE CONSUMMATED HER MARRIAGE

Now that we’ve established that Islam allows husbands to engage in sex with their child-brides, let’s move on to Muhammad and Aisha. The Islamic source materials state that Aisha was 9 when they consummated their marriage.

From the hadith of Bukhari, volume 5, #234

"Narrated Aisha: The prophet engaged me when I was a girl of six. We went to Medina and stayed at the home of Harith Kharzraj. Then I got ill and my hair fell down. Later on my hair grew (again) and my mother, Um Ruman, came to me while I was playing in a swing with some of my girl friends. She called me, and I went to her, not knowing what she wanted to do to me. She caught me by the hand and made me stand at the door of the house. I was breathless then, and when my breathing became all right, she took some water and rubbed my face and head with it. Then she took me into the house. There in the house I saw some Ansari women who said, "Best wishes and Allah's blessing and a good luck." Then she entrusted me to them and they prepared me (for the marriage). Unexpectedly Allah's messenger came to me in the forenoon and my mother handed me over to him, and at that time I was a girl of nine years of age."

Bukhari vol. 7, #65:

"Narrated Aisha that the prophet wrote the marriage contract with her when she was six years old and he consummated his marriage when she was nine years old. Hisham said: "I have been informed that Aisha remained with the prophet for nine years (i.e. till his death).""

From the hadith of Muslim, volume 2, #3309

Aisha reported: Allah’s Messenger married me when I was six years old, and I was admitted to his house at the age of nine….

From the hadith of the Sunan of Abu Dawud, volume 2, #2116

"Aisha said, "The Apostle of Allah married me when I was seven years old." (The narrator Sulaiman said: "Or six years."). "He had intercourse with me when I was 9 years old."

From "The History of Tabari", volume 9, page 131

"Then the men and women got up and left. The Messenger of God consummated his marriage with me in my house when I was nine years old. Neither a camel nor a sheep was slaughtered on behalf of me"...(The Prophet) married her three years before the Emigration, when she was seven years old and consummated the marriage when she was nine years old, after he had emigrated to Medina in Shawwal. She was eighteen years old when he died.

From the Encyclopedia of Islam, under "Aisha":

"Some time after the death of Khadija, Khawla suggested to Muhammad that he should marry either Aisha, the 6 year old daughter of his chief follower, or Sawda Zama, a widow of about 30, who had gone as a Muslim to Abyssinia and whose husband had died there. Muhammad is said to have asked her to arrange for him to marry both. It had already been agreed that Aisha should marry Djubayr Mutim, whose father, though still pagan, was friendly to the Muslims. By common consent, however, this agreement was set aside, and Muhammad was betrothed to Aisha... The marriage was not consummated until some months after the Hidjra, (in April 623, 624). Aisha went to live in an apartment in Muhammad's house, later the mosque of Median. She cannot have been more than ten years old at the time and took her toys to her new home."



SUMMARY OF THE EVIDENCE OF AISHA'S AGE

The above references are just a sample of the Islamic source material statements that Aisha was 9 when her marriage was consummated. Over and over again the great Islamic scholars state that Aisha was 9 when her marriage was consummated. No serious Muslim scholar doubts this. 4) EVIDENCE THAT MUHAMMAD HAD SEX WITH AISHA PRIOR TO HER FIRST MENSES

We’ve seen that Islamic doctrine allows for prepubescent children to be engaged in intercourse, and that Aisha was 9 when Muhammad had sex with her for the first time. Now we’ll look at the evidence and see that Aisha was prepubescent when Muhammad had sex with her.

The hadith state that Aisha was taken to Muhammad’s house, as his bride, when she was 9 and she took her dolls with her as play toys. I’ll borrow some excerpts from Sam’s article here:

'A'isha reported that Allah's Apostle married her when she was seven years old, and he was taken to his house AS A BRIDE WHEN SHE WAS NINE, AND HER DOLLS WERE WITH HER; and when he (the Holy Prophet) died she was eighteen years old. (Sahih Muslim, Book 008, Number 3311)

'A'isha reported that she used to PLAY WITH DOLLS in the presence of Allah's Messenger and when her playmates came to her they left (the house) because they felt shy of Allah's Messenger whereas Allah's Messenger sent them to her. (Sahih Muslim, Book 031, Number 5981)

When the Apostle of Allah arrived after the expedition to Tabuk or Khaybar (the narrator is doubtful), the draught raised an end of a curtain which was hung in front of her store-room, revealing some dolls which belonged to her.

He asked: What is this? She replied: My dolls. Among them he saw a horse with wings made of rags, and asked: What is this I see among them? She replied: A horse. He asked: What is this that it has on it? She replied: Two wings. He asked: A horse with two wings? She replied: Have you not heard that Solomon had horses with wings? She said: Thereupon the Apostle of Allah laughed so heartily that I could see his molar teeth. (Sunan Abu Dawud, Book 41, Number 4914)



A Muslim scholar says that it is okay for Aisha (and other children) to play with dolls because they are not considered adults:

Al-Khattaabee said: From this Hadeeth it is understood that playing with dolls (al-banaat) is not like the amusement from other images (suwar) concerning which the threat (wa'eed) of punishment is mentioned. The only reason why permission in this was given to 'Aa'isha (may Allah be pleased with her) is because SHE HAD NOT, AT THAT TIME, REACHED THE AGE OF PUBERTY. (Source)



Examining the evidence from the previous sections we see

1. Islam allows sex with prepubescent children who are married

2. Aisha was playing with dolls after she consummated her marriage with Muhammad

3. Under Islam’s rules, female children were allowed to play with dolls because they had not yet entered puberty, i.e. had their first menses and became adults.



Therefore, the only conclusion that can be made is that Muhammad was having sex with a Aisha while still was a child! The Quran allows this, Muhammad did this, Aisha stated this, and the scholars affirm this. Now Islam’s children have to deal with this.

Muhammad and his followers fought many battles. Some were offensive some were defensive. Following a victory the Muslims would take captives, or prisoners of war. Muhammad would usually distribute the captives, both male and female, as slaves to his soldiers. Islam provides some basic rights to its slaves but these rights are limited. Naturally, the rights or demands of the slave owner were greater than those of the slaves.



Female slaves were used for primarily for work. But they also provided another service to their male masters ....

"Not so the worshippers, who are steadfast in prayer, who set aside a due portion of their wealth for the beggar and for the deprived, who truly believe in the Day of Reckoning and dread the punishment of their Lord (for none is secure from the punishment of their Lord); who restrain their carnal desire (save with their wives and their slave girls, for these are lawful to them: he that lusts after other than these is a transgressor..."





This verse shows that Muslim men were allowed to have sex with their wives (of course) and their slave girls.

"...who restrain their carnal desires (except with their wives and slave girls, for these are lawful to them..."



Again, Muslim men were allowed to have sexual relations with their wives and slave girls.

Our hopes of reducing child and maternal mortality, combating HIV/Aids and achieving universal primary education are damaged by the fact that one in seven girls in the developing world – and it is overwhelmingly girls who suffer this fate - are married before they reach 15. So, too, are our ambitions to eliminate extreme poverty and promote gender equality.

The statistics are stark. In poor countries, babies born to mothers under 18 are 60% more likely to die in their first year than those born to older women. Girls under 15 are five times more likely to die during pregnancy and childbirth than women in their 20s. Lack of information, marriage to much older men and the inability to negotiate safe sexual practices also puts child brides at greater risk of HIV infection than their unmarried peers.

Child brides are more likely to drop out of school to concentrate on domestic chores and child rearing. But this bias against educating girls starts even earlier. In societies where girls are normally married off young, there can seem little point in investing in their education.

Poverty is a major driver of child marriage. In many poor countries and communities, marrying off a daughter relieves a family of an extra mouth to feed. A bride price or dowry can also be a much-needed windfall for desperate families.

All this has a damaging inter-generational impact. The children of young and poorly educated girls tend to do less well in school and have lower earnings as adults, perpetuating the cycle of poverty.

Child marriages take place in every continent but they are particularly common in south Asia and parts of sub-Saharan Africa. Child marriage rates reach 65% in Bangladesh and 48% in India – 76% in Niger and 71% in Chad. In the coming decade an estimated 100 million girls will be married before they reach 18.

You might think, given the powerful evidence of the damage caused to individuals and societies, that the practice of child marriage would be high on both national and global agendas. But what is striking is the discrepancy between the scale and seriousness of the problem and the attention it has been given.

We understand, of course, the reluctance to intervene in what is traditionally considered a family matter. We recognise that child marriage is embedded deep in the traditions of many societies and is all too often sanctioned by religious leaders. Change will not be easy.

There is some evidence that, thanks to grassroots campaigns and new economic opportunities for women, child marriage is in decline in some parts of the world. However, at the current rate of progress, it will take hundreds of years to disappear. The challenge is how we can help communities accelerate change.

This is why we and our fellow Elders are committed to drawing attention to the damage that child marriage is causing and to supporting those working towards ending it. This means a new emphasis on engagement, debate and education – especially at the community level.

We actively seek wider engagement with religious leaders on this issue. No religions we know explicitly promote child marriage. The fact that religious leaders condone and sanction it in many societies owes more to custom and tradition than doctrine. But we cannot allow the distortion of faith or long-standing custom to be used as an excuse to ignore the rights of girls and women, and to hold their communities in poverty.

What we have learned over the years is that social change of this kind cannot be imposed from above. Laws have little impact. The overwhelming majority of countries already outlaw child marriage through domestic legislation or are signatories to international treaties that prohibit it. But this has not fed through to change on the ground. In Zambia, for example, the legal minimum age for marriage is 21, yet 42% of girls are married by the age of 18 and nearly one in 12 by the time they reach 15. Similar contradictions are evident in many countries.

National and international communities are increasingly recognizing child marriage

as a serious problem, both as a violation of girls’ human rights and as a hindrance

to key development outcomes



On balance, the results from this composite of evaluations lean toward positive findings,

indicating that a set of strategies focusing on girls’ empowerment, community mobilization,

enhanced schooling, economic incentives and policy changes have improved knowledge,

attitudes, and behavior related to child marriage prevention



The consequences of child marriage to the girls who experience it can be devastating

(Jain & Kurz 2007; UNICEF 2001; 2005; Mathur et al 2003). Early marriage leads to

early childbearing, with significantly higher maternal mortality and morbidity rates as

well as higher infant mortality rates (Mensch 2005; UNICEF 2005; Save the Children

2004; Bott & Jejeebhoy 2003). Moreover, child marriage has negative effects on girls’

education. Girls with low levels of schooling are more likely to be married early, and

child marriage virtually puts an end to a girl’s education (Mathur et al 2003; Mensch 2005;

Jejeebhoy 1995). A child bride’s lack of education and peers limits her support systems,

and without skills, mobility, and connections, she is constrained in her ability to overcome

poverty for herself, her children, or her family. Young girls married to older men with more

sexual experience are also at greater risk of HIV infection (Clark 2004), and child brides

are at heightened risk of violence in the home (ICRW 2005; Santhya et al 2010).



The lack of education, health, physical safety, and autonomy deprives girls of their

basic human rights, and it also acts as a brake to social and economic development.

National and international indicators on maternal health, education, food security,

poverty eradication, HIV/AIDS, and gender equality are all negatively linked with high

child marriage rates. In fact, child marriage undermines the achievement of each of

the eight Millennium Development Goals and global targets to reduce poverty worldwide

(UNICEF 2006).

In the realm of child marriage prevention, more creative evaluation

approaches may be necessary to effectively understand and appreciate the extent to

which the desirable change has materialized. Researchers, implementers and donors

working in the field will have to decide whether they are wedded to positivist social

science or are willing to explore emerging thinking on “systems change” and “collective

impact,” which may be better suited to the endeavor of child marriage prevention





it is possible that the evaluation occurred too soon.

Programs have deployed a set of five core strategies to prevent child marriage:

• Empowering girls with information, skills and support networks

• Educating and mobilizing parents and community members

• Enhancing the accessibility and quality of formal schooling for girls

• Offering economic support and incentives for girls and their families

• Fostering an enabling legal and policy framework

Find the right balance between depth versus scale and sustainability by relying

on the experience of child marriage prevention experts, and also exploring new

government and private sector platforms and partnerships in the education,

health and economic sectors.

KUALA LUMPUR — Malaysia's religion minister on Tuesday defended Islamic laws that allow girls under 16 to marry, amid a controversy over two youngsters who were married off to middle-aged men.

The issue has flared in Malaysia after reports that two girls aged 10 and 11 were wed in the conservative northern state of Kelantan last month. They have now been removed from their husbands.

Rights groups have called for the reform of Islamic laws that allow marriage under the age of 16 if religious officials give their consent. Sharia law runs in parallel with civil law in multi-ethnic Malaysia.

"There is no need to amend the law," Jamil Khir Baharom, a cabinet minister in charge of religious affairs, told reporters.

"The law already exists... marrying someone aged 16 and below requires the consent of the court. The court does not simply grant the consent," he said.

"Maturity is a subjective question. It depends on the development of the person. Maturity is not based on age solely."

Pressure group Sisters in Islam has called for an end to child marriages, saying the practice was "unacceptable" but continued in Malaysia because of a "belief that Muslim girls can be married off once they reach puberty".

The fact that people seem to care, write about it, but a question arise.



Rational for letting that happen:



Religious.

Rational, maturity subjective are ‘reason’ used by people wanting this type of ‘sexual exploitation’ to go on. They will say that a child might be mature enough to marry an adult.

In every country this more than a scourge might happen, and happen in a gross scale under Christianity or Hindu religion influence. However one could have a particular concern about Islamic interpretation of the Hadith:



Religious people will preach that Mohamed had four wives in order not to consummate their marriage (even so children had been registered) but to simply give to women the legal protection they needed. At the time being a widow or unmarried could equal to being doomed to ‘abject poverty’. Also the polygamous “status” of mahammad, officialising other marriage would be trumped by saying that these marriage were not consummated. But economical household only, within which what liberty were octroied is some details I haven’t studied.

Also these material are very difficult to handle as a non Arabic speaker, non theologian, non historian…thus whatever might be found would be subject to interminable theorization and interpretation. Also my aim here is not to advocate a way of interpretation and thence not judging the texts of Islamic believes but doing so to the way they are discussed by ‘believers’ and worshippers and take as a justification for present actions and edits.



Mohammed in in most sources said to have ‘legally married’ four women. The last of which was a 6 year old called Aisha, with whom Mohammed had sexual intercourse when she was a 9 year old and him an over 50 year old character.

In many places, of course, that story is taken to justify actual and today’s institutionalized pedophilia (see case study) (Silas, 2011).





Sociologic:

Should one care about rational? Cultural relativism is used to give many reasons about child marriage customs, and defend the fact that nothing is done or should be done ‘in a quiet manner’ as it is society practices’. Cultural relativism is a viewpoint adopted by many in sociology.



Cultural relativism is a widely held position in the modern world. Words like “pluralism,” “tolerance,” and “acceptance” have taken on new meanings, as the boundaries of “culture” have expanded. The loose way in which modern society defines these ideas has made it possible for almost anything to be justified on the grounds of “relativism.” The umbrella of “relativism” includes a fairly wide range of ideas, all of which introduce instability and uncertainty into areas that were previously considered settled.

However, the problem with moving from cultural perspective to cultural relativism is the erosion of reason that it causes. Rather than simply saying, “we need to understand the morals of other cultures,” it says, “we cannot judge the morals of other cultures,” regardless of the reasons for their actions.

I will argue that some people demonstrate how Western thinking is biased in saying that it is only about “what we think”, that culture is a matter of opinion. I would answer that it is not about no one thinks but what about facts. It is not about taking into consideration how I feel, or how the average people, anyone feel but to concentrate on what the girls endure.

Also on a larger reciprocity, if they want to know what people think and feel well it would be just fair enough that they go under, through the torture that they let happen in the name of ‘relativisation’, ‘tolerance’ or ‘diplomacy’.

Similarly, to take a different analogy, if you permit sexual mutilation, then to understand how it is injustice, would it be useful to think yourself without sex, clitoris or penis?

Even, in breach of such bodily integrity (whatever body mutilation or sexual slavery) retributive justice would make sense happening. Ex: if one is threatening a child and that there is no possibility to stop you but imprisonment then should prevail such punishment.

One question certainly less reviewed by officials is the links between child marriage, and slavery, domestic abuses and torture. Or the fact that children has to be protected not because of the measurable results on criteria and evaluation but because to ‘marry’ a child to an adult (constant biologic) is an act of torture, total control upon personal development, “to own another life, and perpetual violation.

IRAN EXECUTES 2 GAY TEENAGERS (updated)

Two gay Iranian teenagers -- one 18, the other believed to be 16 or 17, were executed this week for the "crime" of hom-osexuality, the Iranian Student News Agency (ISNA) reported on July 19. For the last 10 years sexual orientation has been included in a list of discriminatory grounds for executions – gay rights activists say the vote to remove that listing is “dangerous and disturbing.”



The UN resolution urges countries to protect the right to life of all people, calling on them to investigate killings based on discriminatory grounds. Sexual orientation was previously listed as one of these forms of discrimination, alongside ethnicity, religious belief and linguistic minorities.



Others protected by the resolution were human rights defenders (like journalists, lawyers and demonstrators), street children and members of indigenous communities.



But now sexual orientation has been taken out of the list. The amendment was supported by Benin in Africa on behalf of the African Group in the UN General Assembly. It passed on a narrow vote of 79 for, 70 against , 17 abstentions and 26 absent.



Some of those voting to remove sexual orientation were countries where gays are known to be or thought to be executed or summarily killed including Iran, Nigeria, Sudan, Saudi Arabia, Yemen and Iraq.



The UK, US, Australia, New Zealand and many European countries voted in favour of gays.



Cary Alan Johnson, Executive Director of the International Gay and Lesbian Human Rights Commission, said: “This vote is a dangerous and disturbing development. It essentially removes the important recognition of the particular vulnerability faced by lesbian, gay, bisexual and transgender people – a recognition that is crucial at a time when 76 countries around the world criminalise homosexuality, five consider it a capital crime and countries like Uganda are considering adding the death penalty to their laws criminalising homosexuality.”
